This website bnnestate.com, including subdomain/s of bnnestate.com and any other website/s mentioned on the website through which its services are made available for desktops, laptops, tablets, mobile phones, API (application program interfaces) and other smart device applications etc., (hereinafter collectively referred to as "BNNEstate")is owned, hosted and operated by BNNEstate.com, #220/221, Room No-53, 1st Floor, Mayura Nivas, 4th Main Road Chamarajpet Bengaluru - 560018.

Any and all use of BNNEstate is subject to, and constitutes acknowledgment and acceptance of, the following Terms and Conditions ("Terms"). It is mandatory for all Users of BNNEstate to have read carefully, fully understood and be in total agreement to the below mentioned Terms before they proceed to use any of the services of BNNEstate. The Services are available only to those individuals, firms or companies who can form legally binding contracts under the Indian laws. BNNEstat may amend these Terms of Use at any time by posting the amended version on this site. Such amended version shall automatically be effective upon its posting on this site.

This Agreement, accepted upon use of the Site and further affirmed by becoming a User of the BNNEstate, contains the entire agreement between you and BNNEstate.com regarding the use of the Site and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.

DEFINITIONS

Subscriber / User

The term Subscriber / User would include any person, whether an individual or a legal entity who has subscribed to the services of BNNEstate and to whom the access to BNNEstate is restricted by the use of a login user name and password. The user name and password are either allotted by BNNEstate or chosen by the Subscriber. Only the authorized Subscriber has the right to access the services offered by BNNEstate. Advertisers are also Subscribers.

Visitor

The term Visitor will mean and include a person who utilizes any of the services offered by BNNEstate, without the need to create an account. A Visitor without and account can only access non-restricted portions of BNNEstate.

Un-Authorized User

Any person who does not have a legal or a contractual right to access the services, but does so, will fall within the definition of an 'unauthorized User' and will nevertheless be subject to the terms and conditions regulating the usage of BNNEstate, and expressly so with respect to respecting the intellectual property rights of the BNNEstate, and abiding by terms and conditions below mentioned.

Service / Services

The terms 'Service' or 'Services' would mean to include all the information technology enabled services offered by BNNEstate on the internet through which the user may access information or data carried by BNNEstate in the database or other portions  maintained by it. The Service / Services includes posting and maintainence of data by Subscribers / Users / Visitors on BNNEstate. The Service / Services also includes the use of communication tools provided on BNNEstate for exchange of information between Subscribers / Users, BNNEstate and Visitors to the site.

Free Services

Free Services are those services available to any Subscriber / User that joins BNNEstate just with the intention using various 'Free to Use' services on BNNEstate without availing any specialized services.

Paid Services

Paid Services are those specialized services available to any Subscriber / User that joins BNNEstate and it involves financial obligations for its use. These services are also referred to as 'Paid Services'.

RERDA

The term RERDA shall mean and include the Real Estate (Regulation and Development) Act, 2016 and any amendment thereafter.


POSTING AND MANAGEMENT OF LISTINGS/ADVERTISEMENTS

User agrees to only submit and list property descriptions, photographs, financial, contact or other information contained in property listing data to BNNEstate for which he/she has acquired and received all necessary rights and authorizations from the owner of such property or the power-of-attorney holder, including from the photographer and/or copyright owner of any photographs for the purpose of publishing and advertising the said Property(s) on BNNEstate.

BNNEstate.com does not take any ownership, directly or indirectly towards any person whatsoever, with respect to property listings, advertisements or banners hosted on its website by its customers. Any posting of digital content on BNNEstate by customers is strictly through sale of virtual space or free provision of virtual space by BNNEstate.

BNNEstate.com has not carried out any independent verification on the authenticity or compliance requirements, as may have been required under any law that existed or is existing, of such digital content. No guarantees are made by BNNEstate.com for accuracy or completeness of any digital content posted on BNNEstate. Some images and videos might have been posted by BNNEstate or third parties for representational purposes only without the intention of influencing any purchase or decision making.

In case a User is covered under the RERDA, it shall obtain all the required approvals, licenses and permits issued by the competent authorities with respect to the property in the listing, and act as per the guidelines / rules while listing the property on BNNEstate by following the due process of law. The User shall disclose all material factual information as regarding the property being advertised. BNNEstate may also require the User to support his/her claims with respect to the status of the property with such documents as may be specified by it from time to time.

BNNEstate.com will, in its sole discretion, terminate the accounts of, and refuse Service to, any User who intentionally violates the terms and conditions. Additionally, the User agrees to allow the Property listing, or any part of it, to be searched, displayed, accessed, downloaded, copied by the users of BNNEstate. BNNEstate shall have the sole authority to choose the manner in which any Property will be searchable, displayed, accessed, downloaded, copied, and otherwise used on BNNEstate. BNNEstate.com reserves the right to remove all or any part of the Properties posted on BNNEstate without notice.

User will be solely responsible for retaining back-up copies of all information, photographs and other materials furnished/submitted to BNNEstate.

Users, who are buying/renting property/properties through BNNEstate, must verify details the property/properties as well as its right, title, ownership, lien etc. on their own. BNNEstate.com shall not be responsible for any loss or eventualities arising out of these transactions.


USER'S OBLIGATIONS

The User agrees and expressly states that he/she is solely responsible for the accuracy and completeness of the registration data and other information submitted to BNNEstate in the application for subscription in order to use the service. The User will ensure that the data shared with BNNEstate doesn't contain any fraudulent, false, misleading or manipulated facts.

The User agrees to have / have acquired and received all necessary rights and authorizations from the owner of such property or the power-of-attorney holder, including from the photographer and/or copyright owner of any photographs for the purpose of publishing and advertising the said Property(s) on BNNEstate.

In case a User is covered under the RERDA, it shall ensure all necessary compliance necessary, including but not limited to obtaining the necessary registrations etc.

The Site may also require the User to support his/her claims with respect to the status of the property with such documents as may be specified by it from time to time.

The User will comply with all notices or instructions given by the Company from time to time in respect of the use of the Service.

The User shall be solely responsible for all information retrieved, stored and transmitted through the Service by him.

The User is solely responsible for the maintenance of confidentiality of the login information and all activities and transmission performed by the User at BNNEstate.

The User will immediately notify BNNEstate.com of any unauthorized use of the User's account or any other breach of security known to the User.

The User will pay promptly the Subscription Fees as required by BNNEstate.com from time to time.

In case an User chose to discontinue the association with BNNEstate.com, it can unsubscribe / remove the account by completing the delisting procedure on BNNEstate.

PROHIBITED USE

The User shall not put to use the Services offered by BNNEstate.com in any manner that impairs the interests and functioning of the Site/s and which is non-compliant with laws and regulations including RERDA.

The User will not allow any person other than the authorized person(s) named in the application form to use the Service.

The User shall use the Service only for the purpose for which it is subscribed.

The User will comply with all applicable laws and shall not contravene any applicable law of India relating to the Services, including any regulation made pursuant thereto.

The User shall not to use the Service to send or receive any message, which is offensive on moral, religious, racial or political grounds or of an offensive, vulgar, obscene, malicious or menacing nature.

The User shall be prohibited in persistently sending messages or make postings on BNNEstate to any other User or third party who access BNNEstate without reasonable cause or for causing any peril, harassment, annoyance, irritation, or anxiety to any person.

The User is prohibited to introduce, upload, post, distribute, publish or transmit any information or software that:

  • Contains a virus, worm or other harmful component into the Internet or BNNEstate network system.
  • Breaches on any intellectual property rights of any person or retain information in any computer system or otherwise with such intention.
  • Is unlawful, or which may potentially be perceived as being abusive, defamatory, libelous, harmful, threatening, harassing, vulgar, obscene, or racially, ethnically, or otherwise objectionable.
  • Is meant to mislead or deceive the other Users
  • Infringes any trademark, patent or copyright rights


SUSPENSION / TERMINATION OF SERVICES

BNNEstate.com reserves the right to partially suspend the User's access to certain features, panels, access points or fully terminate a User's Account at any time without assigning any reason or notice to the User (Free and Paid Members) in order to protect the interests of other Users of BNNEstate and / or the interests of BNNEstate.com.

Termination or suspension either fully or partially as deemed fit by BNNEstate may be on reasonable grounds to suspect / on receipt of complaint / a belief / an investigation / a notification from law-making bodies or governing authorities and can be done for any breach of the provisions of this Agreement by the User(s).


PAYMENT TERMS

Payments for the Specialized Services offered by BNNEstate.com shall be on a 100% advance basis. The payment for these Service once subscribed to by the subscriber is not refundable and any amount paid shall stand appropriated. Refund if any will be at the sole discretion BNNEstate.com. BNNEstate.com offers no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the Users card/bank accounts.

If you utilize BNNEstate in a manner inconsistent with the terms and conditions, BNNEstate.com may terminate your access, block your future access and/or seek such additional relief as the circumstances of your misuse may be deemed to be fit and proper.

INTELLECTUAL PROPERTY RIGHTS

All logos, brands, trademarks, registered marks appearing in BNNEstate are the properties either owned or used under license by the Company and / or its associates. All the rights accruing from the same, statutory or otherwise and intellectual property rights wholly vest with the Company / its associates. All rights not otherwise claimed under this Agreement or by the Company / its associates are hereby reserved.

CONFIDENTIALITY

BNNEstate is an online platform and so it cannot guarantee confidentiality of information provided by Users who use the Site. So any breach in privacy due to technical fault or any other means is not the responsibility of BNNEstate.com.

The Users need to be aware that when they voluntarily reveal identification oriented information (name, e-mail address) to anyone resulting in unsolicited messages from third parties, then such interaction is beyond the control and liability of BNNEstate.com.

BNNEstate.com is liable to share all information available with it in response to any legal proceedings including and not restricted to court orders, notices, subpoena, FIR etc.

LIMITATION of LIABILITY

BNNEstate.com only offers a platform to showcase the property listings as digital content and has no role in any transaction or communications and hence shall not be liable for any loss or damage of any sort arising out of the use and/or temporary or permanent discontinuation of its services. Notwithstanding anything to the contrary contained herein, BNNEstate.com, liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to BNNEstate.com, for the Service during the term of membership.

BNNEstate being a public site with free access assumes no liability for the quality and genuineness of responses. BNNEstate.com cannot monitor the responses received by any User in response to the information posted by them and so displayed on the site. User should conduct its own background checks on the bonafide nature of all response(s). BNNEstate.com will not be liable for any inaccuracy of information on BNNEstate.

BNNEstate.com expressly disclaims any liability arising due to presence of any fraudulent information published on the site.

The User is warned against disclosure of any personal / confidential / sensitive information to any previous or current employee of the company. The User would do so solely at his / her own risk and BNNEstate / B shall not be liable for the outcome of any such transaction of information including and not limited to damages for loss of profits or savings, business interruption, loss of information or repute.

RERA DISCLAIMER

The Users who are sellers such as Project Developers / Builders / Real Estate Agents shall obtain necessary registration under the RERA Act and ensure all necessary compliance with the rules, regulations and guidelines of RERA Act 2016. It is mandatory that these Users disclose all the requisite information and relevant details as prescribed in the RERA Act 2016. BNNEstate.Com neither guarantees nor offers any warranty about the information including RERA credentials posted by the Project Developers / Builders / Real Estate Agents as well as their compliance.

USER DISPUTES

The Users are solely responsible for your interactions at BNNEstate and BNNEstate.com reserves the right, but has no obligation, to monitor disputes between Members.

BNNEstate will not be party to any legal proceedings between User and any other registered or free User for any transactions through the Site. BNNEstate.com will always abide by governing / legal authorities order and cooperate fully through the process, but the costs of the same shall be recovered from the party that has implicated BNNEstate.com in such case.

JURISDICTIONAL ASPECTS

For any kind of legal dispute related to BNNEstate / BNNEstate.com would be dealt in only territory of Bengaluru. All the legal issues are subjected only to pertinent contemporary's laws in force at Bengaluru to the jurisdiction of courts located in Bengaluru only.
